The Supreme People's Procuracy charged Bùi Văn Bình, born in 1962 and residing in An Dương Ward, Hai Phong, with violating accounting regulations causing serious consequences and with environmental pollution. Bình is the director of Tân Thuận Phong.
According to the indictment, Tân Thuận Phong processes domestic and industrial waste, recycles materials and trades scrap at Nam Cầu Kiền Industrial Park.
From 2021 to August 2025, while processing hazardous waste, the company collected scrap and sold it to individuals and businesses without signing sale contracts or issuing value-added tax invoices.
Prosecutors allege that Bình instructed Phan Thị Hương Giang, deputy head of the accounting department, and company treasurer Phạm Thị Xuân to collect payments in cash or through transfers to personal accounts. The payments were recorded on handwritten receipts and tracked in Excel, but were not declared to tax authorities.
According to prosecutors, keeping the revenue outside the accounting records to conceal actual income caused more than VND 12.378 billion in tax losses to the state budget. During the investigation, Bình, Giang and Xuân admitted the violations.
Regarding environmental pollution, the indictment says that on February 8, 2025, Tân Thuận Phong signed a contract with H. Co., Ltd. to collect, transport and process industrial waste, including “burnt sand,” at a price of VND 500 per kilogram.
Bình assigned employees to process the waste on a chemical treatment line. However, after the exhaust system became clogged, Bình ordered the processing to stop.
Bùi Đức Huy, Bình's son and deputy director of Tân Thuận Phong, then instructed employees to store the “burnt sand” in the company's waste-treatment workshop area.
By April 2025, a large amount of waste had accumulated. After Bình agreed, Huy allegedly knew that Đông Dương 3 did not have the conditions to receive and process the “burnt sand,” but still instructed employees to contact the company and arrange for the waste to be transferred there to reduce costs.
According to the indictment, Bùi Đình Chung, director of Đông Dương 3, was preparing to level the site for H.V. Company's factory. Because natural sand was scarce and its price had risen, Chung agreed to receive the “burnt sand” for placing and lining drainage and fire-prevention pipes and for burying it to create a factory site.
From April to September 9, 2025, Tân Thuận Phong transported more than 2,663 tonnes of “burnt sand” in total to Đông Dương 3 and H.V. Company.
After receiving it, Chung instructed employees to mix more than 1,678 tonnes of “burnt sand” with sludge to make tunnel bricks. The remaining 984 tonnes were used for burial and ground leveling inside H.V. Company's premises.
The procuracy determined that the actions of Bình, Huy and Chung violated environmental protection regulations. All three admitted their actions and those of their accomplices during the investigation.
In addition to Bình, the Supreme People's Procuracy charged Phan Thị Hương Giang and Phạm Thị Xuân with violating accounting regulations causing serious consequences under Clause 3, Article 221 of the Criminal Code.
Bùi Đức Huy and Bùi Đình Chung were charged with environmental pollution under Point d, Clause 3, Article 235 of the Criminal Code.
